Please read these Terms of Service ("Terms") carefully before using VoicePacer (the "App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using VoicePacer, you agree to these Terms of Service. If you do not agree, do not use the App.

2. License to Use

2.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use VoicePacer for personal, non-commercial purposes.

2.2 Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works
  • Remove or alter any copyright notices
  • Use the App for any illegal purpose
  • Redistribute or resell training plans or content
  • Share your Pro purchase with others (purchases are per Apple/Google account)

3. Training Plans and Content

3.1 Disclaimer

Training plans provided in VoicePacer are for informational purposes only and are inspired by popular training methodologies. For complete training guidance and detailed methodology, we strongly encourage you to:

  • Purchase and refer to the original books (e.g., Jack Daniel's Running Formula)
  • Consult with qualified fitness professionals
  • Follow evidence-based training principles

3.2 Intellectual Property

  • Training plan structures and protocols are based on publicly available training principles
  • We do not claim ownership of training methodologies from published books
  • We encourage users to purchase original training books for comprehensive guidance
  • Custom workouts created by users belong to the users

3.3 Amazon Affiliate Links

We may include affiliate links to Amazon for training books. We earn a small commission if you purchase through these links at no extra cost to you.

4. Health and Safety Disclaimer

4.1 Medical Consultation

IMPORTANT: Before starting any exercise program, consult with a physician or qualified healthcare provider, especially if you:

  • Have any pre-existing medical conditions
  • Are pregnant or nursing
  • Are taking any medications
  • Have been sedentary for an extended period
  • Experience any pain or discomfort during exercise

4.2 Assumption of Risk

You acknowledge and agree that:

  • Physical exercise involves inherent risks of injury
  • You participate in workouts at your own risk
  • You are responsible for knowing your physical limitations
  • You should stop immediately if you feel pain or discomfort
  • VoicePacer is a timing and pacing tool, not a personal trainer

4.3 Not Medical Advice

VoicePacer does not provide medical advice. The App is designed for:

  • Workout timing and pacing guidance
  • Training plan organization
  • Voice-guided interval training

It is NOT a substitute for:

  • Professional medical advice
  • Personalized coaching
  • Fitness assessments
  • Physical therapy

5. In-App Purchases and Payments

5.1 VoicePacer Pro (One-Time Purchase)

Purchase Type:

  • One-time payment - NOT a subscription
  • No recurring charges or auto-renewal
  • Pay once, own forever

Standard Pricing:

  • Regular Price: $9.99 USD (one-time)
  • Promotional pricing may be offered at launch or special events
  • Prices may vary by region and include applicable taxes

What You Get:

  • Permanent ad-free experience
  • Unlimited custom workout creation
  • Access to advanced training plans (Jack Daniel's Running Formula plans)
  • All future updates to existing features
  • No expiration - yours forever

5.2 No Account Required

Important:

  • You do NOT need to create an account to purchase Pro
  • Your purchase is tied to your Apple ID (iOS) or Google Account (Android)
  • We do not collect email addresses or personal information for purchases
  • Purchase verification is handled automatically through RevenueCat

5.3 Payment Processing

  • All payments are processed through Apple App Store or Google Play Store
  • We do not store or have access to your credit card information
  • Billing is handled entirely by Apple or Google
  • All fees are non-refundable except as required by law or Apple/Google policies

5.4 Purchase Restoration

Restoring Your Purchase:

  • Use "Restore Purchases" button in Settings
  • Must use the same Apple ID or Google Account as original purchase
  • Free to restore unlimited times on your devices
  • If you change Apple ID or Google Account, you cannot transfer the purchase

Important Notes:

  • Purchases are per Apple/Google account, not per device
  • Cannot be shared with family members (each needs their own purchase)
  • Cannot be transferred between iOS and Android

5.5 Refund Policy

Refunds are handled by Apple or Google according to their respective policies:

Contact Apple or Google support directly for refund requests.

5.6 Promotional Codes

  • We may offer promotional codes for limited-time free or discounted Pro access
  • Promotional offers are subject to terms specified at the time of offer
  • We reserve the right to limit or revoke promotional codes if abused

5.7 Future Subscription Options

Important Notice:

  • We may introduce subscription-based features in the future
  • Existing Pro (one-time) purchasers will ALWAYS retain their Pro benefits
  • New subscription-only features (if added) will be clearly marked
  • You will never be forced to subscribe if you purchased Pro

6. Advertising (Free Version Only)

6.1 Ad-Supported Free Version

The free version of VoicePacer includes advertisements served by Google AdMob to support ongoing development.

6.2 Daily Ad Requirement

Free users may be asked to watch one advertisement per day to continue using the app. This helps us keep the core features free.

6.3 Ad-Free Experience

Purchase VoicePacer Pro to remove all advertisements permanently.

7. User Conduct

You agree not to:

  • Use the App to harm others or violate any laws
  • Attempt to access restricted areas of the App
  • Interfere with the App's operation or security
  • Upload malicious code or viruses
  • Abuse promotional codes or payment systems
  • Attempt to hack or bypass Pro features
  • Share Pro features with non-purchasers

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Voice guidance will be accurate at all times
  • Training plans will produce specific results

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Personal injuries or death resulting from use of the App or following training plans
  • Loss of data or content
  • Service interruptions or downtime
  • Inaccurate training guidance or voice cues
  • Failure to achieve fitness goals
  • ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

8.3 Maximum Liability

Our total liability shall not exceed the amount you paid for VoicePacer Pro (if any), which is $9.99 USD maximum.

9. Indemnification

You agree to indemnify and hold harmless VoicePacer, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your participation in workouts or training programs
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Injuries sustained during exercise

10. Third-Party Links and Services

The App may contain links to third-party websites or services:

  • Amazon affiliate links for training books
  • Links to Apple App Store or Google Play Store
  • Links to privacy policies of third-party services

We are not responsible for:

  • The content or practices of third-party sites
  • Any transactions you make with third parties
  • Privacy policies of external sites

11. Modifications to the App and Terms

11.1 App Changes

We reserve the right to:

  • Modify or discontinue the App at any time
  • Change features, content, or functionality
  • Add or remove training plans
  • Introduce new features (free or paid)

11.2 Terms Updates

We may update these Terms as needed. Significant changes will be communicated through:

  • In-app notifications
  • Updated "Last Updated" date
  • Email (if you have provided one)

Continued use after changes constitutes acceptance of updated Terms.

11.3 Grandfathering Promise

If we introduce subscription features, existing Pro purchasers will retain all current Pro benefits at no additional cost.

12. Termination

12.1 By You

You may stop using the App at any time by deleting it from your device. Your Pro purchase remains valid if you reinstall (same account).

12.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the App, promotional codes, or other users
  • Attempt to hack or circumvent payment systems

Termination does not entitle you to a refund.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of South Korea, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes shall be resolved in the courts of South Korea. However, you may also have rights under your local consumer protection laws.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and VoicePacer regarding use of the App.
